Services and contract scope
FOXATVs provides organised outdoor self-drive adventures with guides, passenger participation, day trips, multi-day expeditions and related services as described for each product. A booking is for the stated experience, not permission to use the vehicle outside its programme. The agreement consists of the booking confirmation, product description, disclosed special terms, these terms, the risk acknowledgement and safety instructions. The confirmation identifies the actual operator where a partner delivers part of the service.
Acceptance across all booking channels
These terms apply to bookings through the website, WhatsApp, telephone, email, social media accounts, the premises and any official FOXATVs channel or authorised agent. Once these terms and the risk acknowledgement have been presented and made available before confirmation or payment, the customer’s confirmation or full or partial payment constitutes contractual acceptance by conduct, to the extent permitted by law. This includes confirming by message, completing a booking order or paying a deposit after notice. Merely browsing, making an enquiry or supplying preliminary information does not establish this acceptance. Booking acceptance does not replace individual acknowledgements or any expressly required consents.
Eligibility and group bookings
The lead booker must be an adult with legal capacity or an authorised legal representative, provide accurate information and be entitled to use the payment method. Driving and passenger eligibility depend on activity, vehicle and route; age and licence requirements are disclosed before confirmation. The booker supplies participation instructions to companions and each participant completes their acknowledgement, with guardian consent where applicable. Buying a ticket does not guarantee admission of someone who fails the disclosed requirements.
Requests, confirmation and availability
An enquiry, quotation or payment link alone is not a confirmed booking. Confirmation follows completion of disclosed requirements and our confirmation showing the activity, date, location, capacity, amount and payment status. Any temporary vehicle or seat hold states its duration and expires if not confirmed in time. A waiting list does not guarantee availability. A general automated reply is not confirmation unless it includes the booking confirmation issued by the authorised system.
Price, vehicle and extras
The offer states whether pricing is per vehicle or person, included seats and participants, equipment, services, extras and any applicable tax. Capacity may not be exceeded and additional drivers require approval. A confirmed price changes only for a customer-requested modification or lawful later agreement. If a replacement vehicle is needed, an equivalent category is offered where practicable; a material change requires an acceptable alternative or fair treatment of the affected service.
Payment and reconciliation
Only payment methods offered and approved for the booking are used, including the payment gateway, transfer, cash or later payment where available. The deposit, balance and due date are disclosed. Unpaid amounts may result in cancellation under the booking terms after notice and the period stated in the confirmation. Duplicate or pending payments are investigated with the provider. These terms alone do not authorise automatic card charges for damage without a valid basis and authorisation. Customers should keep payment receipts and their booking reference.
Customer cancellation and refunds
Unless a clear product-specific policy is disclosed before confirmation, the rules below apply. Time is measured in hours before the confirmed activity start in Oman time, using receipt of the cancellation request through an official channel. Percentages apply to the amount paid for the cancelled service; refunds cannot exceed that amount.
| Activity / cancellation timing | Refund |
|---|---|
| Day/short activity: at least 24 hours | 100% |
| Day/short activity: under 24 hours | 0% |
| Multi-day: 336 hours or more (14 days) | 50% |
| Multi-day: 168 to under 336 hours | 40% |
| Multi-day: 72 to under 168 hours | 30% |
| Multi-day: under 72 hours | 0% |
Grace period and non-attendance
As a customer-favourable exception, a full refund is available when cancellation is requested within 120 hours of booking confirmation and at least 24 hours remain before a day activity or 336 hours before a multi-day trip. Special arrangements are deductible only if their cost and non-refundable status were disclosed and accepted before commitment. A no-show or late arrival receives no refund for the part missed for that reason, provided the reporting time was disclosed. Rescheduling and participant substitutions depend on availability, eligibility and costs accepted in advance.
Cancellation or changes by FOXATVs and force majeure
Routes or stage timings may change for safety, weather or access restrictions without materially undermining the experience. If we cancel before the start, the customer may choose a refund for undelivered service or rescheduling; credit is not imposed. A material undelivered part after commencement is addressed proportionately to its value. Force majeure is governed by law and does not automatically forfeit payments. Refunds do not automatically include independent travel arrangements we did not undertake, without excluding liability imposed by law.
Refund processing
We confirm the amount and calculation in writing and initiate an approved refund within seven business days after entitlement is resolved and necessary information is available, to the original payment method where practicable. Banks or providers may take additional time to post it; we supply the transaction reference. Using an external provider does not remove the customer’s right to correct a payment error or raise a legitimate dispute.
Safety and responsibility
Participants comply with the acknowledgement, safety instructions and disclosed requirements. Participation creating a risk or involving a material breach may be refused or stopped. Cancellation consequences depend on the reason, delivered service and law. Each party is responsible for its conduct under the risk acknowledgement; these terms neither exclude non-excludable duties nor automatically assign every incident to the customer.
Accounts, automated chat and privacy
Users protect their email and access codes and report unauthorised use. Data is processed under the privacy policy and relevant notices. AI assistants may support enquiries and follow-up; a staff member can be requested through our contact channels. Medical eligibility, damage assessments and dispute settlements are not based solely on an automated reply. Booking does not constitute marketing or publicity consent or open-ended permission for model training or new data-sharing purposes.
Content, external services and changes
Brand and content intellectual property must be respected and may not be commercially exploited without permission. Customers may use personally delivered photographs under the delivery permission while respecting others’ privacy. External links have their own terms, without removing our responsibilities for providers acting on our behalf. Updates apply prospectively and the accepted booking version is retained; material changes to existing bookings require lawful agreement. If a clause is unenforceable, the remainder continues to the extent legally possible.
Travel Insurance
Personal travel insurance is not included. FOX ATVs does not currently provide, sell, underwrite, guarantee, or include personal travel insurance with any adventure, expedition, booking, or activity. Each guest is responsible for obtaining and paying for their own suitable policy.
Insurance is strongly recommended for all activities. Guests must hold suitable personal travel insurance before participation in any adventure, expedition, rally, or programme lasting one full day or more.
Guests must ensure their policy is valid in Oman and expressly covers emergency medical treatment, medical evacuation and repatriation, and their relevant guided self-drive off-road activity as a driver or passenger. Confirm the exact activity and vehicle type: ATV, quad bike, UTV, SSV, dune buggy, desert driving or off-road motorsport, as applicable. Many standard policies exclude motorised off-road activities. Written confirmation from the insurer should be obtained before purchase.
Travel insurance must not be assumed to cover vehicle damage, damage excess, a security deposit, personal liability arising from operating the vehicle, or any obligation under the Terms, Waiver, booking conditions or damage schedule. Failure to obtain insurance, or an insurer’s refusal of cover or a claim, does not reduce or remove those obligations.
FOX ATVs has no commercial partnership, affiliate or commission arrangement with any external insurer or broker, does not represent any insurer, and has no control over or responsibility for policy suitability, quotes, payments, exclusions, claims, insurer decisions, delays, medical-provider settlement, reimbursement or service outcomes. FOX ATVs does not promise cashless treatment, direct settlement, claims approval, coverage, evacuation, reimbursement or any other insurer outcome.
At a guest’s request and subject to availability, FOX ATVs may provide paid administrative assistance or referral support to help the guest contact an independent third-party provider. This is not an insurance policy, insurance advice, brokerage, claims handling or representation of an insurer, and it does not guarantee cover. The guest remains responsible for reviewing the policy wording, confirming suitability and buying the policy separately and directly. Nothing in this clause removes any responsibility that cannot lawfully be excluded.
