Scope and acceptance across booking channels
These terms apply to bookings through the website, WhatsApp, telephone, email, social media accounts, the premises and any official FOXATVs channel or authorised agent. Once these terms and the risk acknowledgement have been presented and made available before confirmation or payment, the customer’s confirmation or full or partial payment constitutes contractual acceptance by conduct, to the extent permitted by law. This includes confirming by message, completing a booking order or paying a deposit after notice. Merely browsing, making an enquiry or supplying preliminary information does not establish this acceptance. Booking acceptance does not replace individual acknowledgements or any expressly required consents.
FOXATVs includes its operating company, staff, guides and authorised contractors within their roles in the activity. The lead booker is responsible for their own obligations and accurate booking information; authority to waive other adults’ personal rights is not presumed.
Nature of the activity and risk acknowledgement
I voluntarily participate in an outdoor self-drive adventure or as a passenger. Desert, mountain, wadi and remote travel involve risks that cannot be eliminated despite precautions. These include loss of control, rollover, collision, falls, changing terrain and visibility, dust, heat, floods, weather, equipment failure, actions of participants or others, and delayed communications or rescue. Serious injury, permanent disability, death or property damage may result. A guide, seat belt, helmet or protective structure does not guarantee freedom from injury.
Detailed disclosure of foreseeable risks
Foreseeable risks include the following categories as relevant to my vehicle, route, season and booked services. This expanded list cannot identify every possible event; unforeseen circumstances may arise. Listing a risk neither authorises unsafe operation nor transfers the operator’s responsibility to the participant.
Loss of control, collision and rollover
Skidding, loss of traction, leaving the route, striking a vehicle, person, animal or obstacle, and sideways, forward or repeated rollover, including at low speed. Occupants may be ejected, trapped beneath the vehicle or suffer crush injuries, particularly when extending their body outside or attempting to arrest a rollover.
Terrain, dunes and mountains
Soft sand, bogging, holes, ruts, rocks, hidden obstacles, changing grip, blind dune crests, steep and side slopes, unstable edges and falling rocks. Bumps, vibration and sudden drops may cause injury without a collision or rollover.
Wadis, water, floods and coastal sections
Changing depth and current, slippery or unstable ground, vehicle submersion or displacement, entrapment and drowning. Floodwater may arrive from distant rainfall even when the local sky is clear. Coastal sections also involve tides, waves and waterlogged sand. Disclosure does not authorise flood crossings or swimming.
Visibility, weather and environmental exposure
Dust, airborne sand, glare, darkness, fog and rain may obscure obstacles or distort distance perception. Risks include wind, storms, lightning, heat and sun exposure, dehydration, heat illness, and cold or wet conditions at altitude or overnight.
Vehicle faults and unexpected breakdowns
Tyres, wheels, steering, brakes, suspension, drivetrain or electrical systems may fail; a vehicle may stop, respond abnormally or run out of fuel. Periodic maintenance and checks reduce these risks but cannot prevent every sudden failure. Listing a fault does not waive the operator’s maintenance duties or liability imposed by law.
Fire, hot surfaces and moving parts
Burns from engines, exhausts and hot fluids; fuel or electrical fires; smoke or exhaust inhalation; and entanglement of clothing, hair or limbs in moving parts. Tyres may throw stones or other debris.
Protective equipment and riding position
Poor fit, misuse or damage to a helmet, seat or restraint can increase injury. Head, neck, back, spinal, eye, dental or hearing injuries, fractures, cuts, bleeding and internal injuries may occur despite protective equipment. A protective structure cannot guarantee freedom from crush injuries; restraint and containment rules apply to vehicles equipped with them, not universally to quad bikes.
Exertion, health and human response
Fatigue, lack of sleep, motion sickness, dehydration, anxiety or panic, delayed reactions, pedal errors and distance misjudgement. Existing conditions may worsen, or an emergency or allergic reaction may arise. Pregnancy, health limitations or recent injuries require checking medical suitability and participation restrictions before booking; medical clearance does not override operational restrictions.
Actions of participants and others
Errors by drivers, passengers, guides or others, sudden stops, following too closely, reckless driving, and movements of pedestrians, animals or other vehicles. Road crossings or road transfers, where included in the approved programme, add traffic risks. Disclosure of possible guide or third-party error does not release anyone from legally established liability.
Recovery and field repairs
Vehicle movement or sliding during recovery, failure of ropes, straps, winch lines or anchor points, flying components, trapping between or beneath vehicles, and falling loads or raised vehicles. Only competent personnel undertake these tasks; participants must not enter the work zone without a clear, safe assignment.
Remote locations, communication and rescue
Disorientation, separation, failed mobile or radio coverage or navigation, and distance from medical care. Access, first aid or evacuation may be delayed by terrain, weather or unavailable resources, potentially worsening an injury. A guide or support vehicle does not guarantee immediate response or air evacuation.
Stops, walking, camping and associated activities
Where included, risks cover slips and falls when boarding, leaving or walking; rock and water edges; guy ropes and sharp tools; campfires, cooking and gas; carbon monoxide from combustion appliances; animal or insect bites and stings; and contaminated food or water or food allergies. Specialist activities such as swimming, climbing or caving require their own assessment, instructions and additional acknowledgement if offered; general permission does not cover them.
Belongings, financial effects and distress
Loss, theft or damage to phones, cameras, documents, clothing and belongings from water, dust or impact; treatment or evacuation costs, disrupted travel, and distress following an incident or witnessing injury. Responsibility follows the facts, law and insurance; listing an effect does not automatically charge it to the participant.
I understand that one or more of these risks may cause minor or serious injury, temporary or permanent disability, death or property damage. Before accepting I request an explanation of any unclear risk, and I do not start a section I cannot undertake safely; I notify the guide.
Eligibility, readiness and accurate information
I provide accurate age, eligibility and driving information and present a valid licence where required by the activity or law. I comply with the activity and vehicle age, seating and restraint requirements. I do not drive under the influence of alcohol, drugs or medication affecting alertness, or participate when unable to do so safely. I confidentially tell the designated staff member about limitations affecting participation, only as necessary, and do not send medical reports through general chat. Operational clearance is not a medical assessment.
Driving rules and guide authority
I follow the briefing, instructions, route, safe speed and following distance, use protective equipment and restraints, and do not use a phone while driving, overtake, drift, jump, race or change drivers without permission. I do not cross water, recover or repair a vehicle without direction. A guide may stop participation, withdraw driving permission or alter the route for a reasonable safety concern. Where a documented material breach by a participant prevents delivery of part of the activity, no refund is due for that part, subject to law and the booking terms.
Assumption of risk and legally permitted release
I assume the disclosed inherent risks remaining despite reasonable precautions and the consequences of my own actions, breaches and negligence to the extent attributable to me. To the fullest extent permitted by law, I release FOXATVs and its authorised staff and guides from claims arising solely from those risks or my actions, except where the claim arises from established responsibility that cannot lawfully be excluded.
This release does not exclude liability arising from a harmful act where exemption is void by law, fraud, wilful misconduct, gross negligence, or any liability or right that the law prohibits excluding, including those relating to injury and death. Maintenance failures or pre-existing defects are not charged to me merely because they occur during participation. Nothing restricts complaints or judicial remedies.
Damage responsibility and indemnity
I compensate direct damage and reasonable documented costs proven to result from my breach, misuse or negligence. These may include repairs or replacement of irreparable property, incident-related recovery and transport, third-party claims and legal costs permitted by law or awarded by a competent authority. Compensation is proportionate to my actual responsibility and excludes unrelated fault of the company or others and ordinary wear. The same loss is not recovered twice; insurance or compensation already received for that loss is taken into account.
Inspection, reporting and damage resolution
I immediately report any incident, injury or fault to the guide and stop using an unsafe vehicle. Vehicle condition is recorded before and after handover with photographs and notes where practicable. The assessment identifies the incident, parts, costs and basis of responsibility, separating prior damage and ordinary wear. The participant may object and submit an independent specialist quotation. Unresolved disputes go to an agreed expert or competent authority; management’s assessment alone is not a final, unreviewable determination.

These are preliminary estimates, not automatic penalties or minimum debts where damage is not established. The final amount depends on model, condition and reasonable actual cost; the quotation states whether labour, transport and any applicable tax are included. Incident and parts estimates are not added for the same loss. Total-loss recovery does not exceed the justified pre-incident value after accounting for salvage and compensation.
Insurance, rescue and belongings
Personal travel insurance is not included. FOX ATVs does not currently provide, sell, underwrite, guarantee, or include personal travel insurance with any adventure, expedition, booking, or activity. Each guest is responsible for obtaining and paying for their own suitable policy.
Insurance is strongly recommended for all activities. Guests must hold suitable personal travel insurance before participation in any adventure, expedition, rally, or programme lasting one full day or more.
Guests must ensure their policy is valid in Oman and expressly covers emergency medical treatment, medical evacuation and repatriation, and their relevant guided self-drive off-road activity as a driver or passenger. Confirm the exact activity and vehicle type: ATV, quad bike, UTV, SSV, dune buggy, desert driving or off-road motorsport, as applicable. Many standard policies exclude motorised off-road activities. Written confirmation from the insurer should be obtained before purchase.
Travel insurance must not be assumed to cover vehicle damage, damage excess, a security deposit, personal liability arising from operating the vehicle, or any obligation under the Terms, Waiver, booking conditions or damage schedule. Failure to obtain insurance, or an insurer’s refusal of cover or a claim, does not reduce or remove those obligations.
FOX ATVs has no commercial partnership, affiliate or commission arrangement with any external insurer or broker, does not represent any insurer, and has no control over or responsibility for policy suitability, quotes, payments, exclusions, claims, insurer decisions, delays, medical-provider settlement, reimbursement or service outcomes. FOX ATVs does not promise cashless treatment, direct settlement, claims approval, coverage, evacuation, reimbursement or any other insurer outcome.
At a guest’s request and subject to availability, FOX ATVs may provide paid administrative assistance or referral support to help the guest contact an independent third-party provider. This is not an insurance policy, insurance advice, brokerage, claims handling or representation of an insurer, and it does not guarantee cover. The guest remains responsible for reviewing the policy wording, confirming suitability and buying the policy separately and directly. Nothing in this clause removes any responsibility that cannot lawfully be excluded.
Staff may request necessary emergency assistance or evacuation; this document is not an unlimited medical authorisation. Rescue and treatment costs are allocated according to facts, law and any applicable insurance. I take care of my belongings without excluding established company responsibility.
Other participants and minors
The lead booker supplies these terms to accompanying participants and provides their details with appropriate authority. Each adult completes their own acknowledgement before participating. A minor’s parent or legal representative completes the required acknowledgement and authority verification. Parental consent does not waive a minor’s protected rights or permit participation in an activity for which the minor is ineligible.
Personal travel insurance acknowledgement
I understand that FOX ATVs does not provide personal travel insurance. I am responsible for arranging my own suitable insurance and understand that such insurance may not cover all risks, vehicle damage, personal liability, or my obligations under this waiver and the booking terms. I understand that I should confirm that my policy covers my participation in guided self-drive ATV, UTV, SSV, quad bike, dune buggy, or off-road activities in Oman.
I understand that insurance is strongly recommended for every activity and that suitable cover is required before participation in any programme lasting one full day or more.
Individual acknowledgement and acceptance record
I acknowledge receiving this document before acceptance, reading it or having it explained in a language I understand, and having an opportunity to ask questions. I agree to participate and accept the stated obligations within the law. Electronic or paper records include participant name and role, booking reference, acceptance date and document version. This acknowledgement does not grant marketing or publicity consent; those permissions are collected separately.
Contact and governing law
